Terms and Conditions

1.      General Raffle Terms and Conditions

1.1.       Open to residents of Australia only and limited to one entry per person.

1.2.       Entries must be received before 10:30pm Saturday 2 February 2013. Competition opens midday Saturday 2 February 2013.

1.3.       A representative of Opera Australia will draw the raffle on Monday 4 February 2013.

1.4.       Prizewinners will be notified via phone by Friday 8 February 2013.

1.5.       Employees of Opera Australia, Tourism Victoria, Mazda Australia, ARIA Restaurant, The Langham Sydney, Family Image and Ananas Brasserie, including any member associations, and families of these employees are not eligible to enter.

1.6.       The total value of the prizes is approximately $12,500.

1.7.       If the prize is not claimed by 30 April 2013, the Department of Gaming and Racing will be notified.

1.8.       Unless specified, the winner will be responsible for any expenses incurred in getting to and from their accommodation.

1.9.       The promoter takes no responsibility for insurance, health, luggage, personal expenses, meals, transport and accommodation other than specified.

1.10.     By entering the raffle you agree to receive email communication from OA which you can unsubscribe from at any time.

1.11.      The prizewinners will be responsible for any expenses incurred in getting to and from the city of Sydney when utilising their prize.

1.12.      Each prize must be taken as stated and no compensation will be payable if a winner is unable to use the prize as stated. Prizes are not exchangeable or redeemable for cash or other goods or services.  Any prize which is unused will be forfeited. 

1.13.      A prize cannot be transferred to any other person, unless agreed to by the Promoter. 
 

2.      1st Prize Terms and Conditions

2.1.       Due to the popularity of these experiences, we recommend booking prize components at least 6 weeks in advance. Experiences valid until 31 December 2013 and flights are for travel completed by 31 December 2013.

2.2.       Prize is subject to availability and cannot be redeemed over public holidays or between 24 December 2013 and 2 January 2014.

2.3.       Opera Australia, MAZDA, and Tourism Victoria make no representation as to the safety conditions or other issues that may exist at any destination. Unless otherwise stated, the prize does not include travel insurance, passports, visas, meals, taxes not included in the price of the ticket, ground transportation or any other costs of a personal nature not stated. 

2.4.       The Promoter promotes and encourages consumers to drink responsibly. Legal aged consumers should be advised to consider the safe drinking levels recommended in the National Health and Medical Research Council Australia Alcohol Guidelines. These are available at: http://www.alcohol.gov.au/

2.5.       By entering this competition, entrants accept and acknowledge full responsibility for their decision to participate in all aspects of the prize should they be chosen as winner. The winner releases the Promoter, MAZDA and other organisers, their related bodies corporate, affiliates, officers, agents and employees, from all liabilities, loss and damage of any kind arising at any time out of or in connection with the acceptance of, and participation in, the prize. Without limiting the foregoing, the released parties are not be liable for any injury, sickness or death, property loss or damage or other direct or indirect loss or damage of any kind, howsoever sustained or incurred, in connection with or arising out of any aspect of the prize. The winner acknowledges that they have been warned that there is a possibility of an accident causing injury, death or property damage in accepting the prize.

2.6.       The winners must comply with all MAZDA agreements at the time of the loan. The vehicle cannot be driven out of 200km from the metropolitan area it is loaned from and must only be driven on sealed roads.

2.7.       In the event that the vehicle is involved in an accident or damaged in anyway, an Accident/Damage Report in the form required by MAZDA must be completed and forwarded to the MAZDA office that the vehicle was collected from within 24 hours of the damage occurring. Repairs to the vehicle are not to be undertaken without the written consent of MAZDA or its appointed assessor.

2.8.       MAZDA retains the title to the vehicle and the winner must not purport to sell, pledge, mortgage, lend, transfer, or in any way encumber the vehicle. All costs relating to insurance, registration, service, repairs, etc, of the vehicle will be borne by MAZDA except for the following items which the winner will be responsible for including but not limited to any negligent act performed by the driver or passengers involving the said vehicle: any loss or damage caused to, or by, the vehicle should the winner (or driver) be intoxicated or under the influence of medication or drugs whilst in control of the said vehicle: or any fines or penalties incurred for traffic infringements whilst the vehicle is in the custody and control of the winner (or nominated driver). The winner is to return the car to MAZDA immediately upon completion of their weekend away and if the winner fails to do this, MAZDA is irrevocably authorised to enter any premises in which they believe the vehicle to be situated and take possession of and remove the vehicle. The MAZDA pickup locations and timings are as below:

a. VICTORIA

i.          Pick up Location: Mazda Australia, 385 Ferntree Gully Rd, Mount Waverley

ii.         Pick up Date/Time: Date TBC, Time between 12-5pm

iii.         Drop off Location: Mazda Australia, 385 Ferntree Gully Rd, Mount Waverley

iv.        Drop off Date/Time: Date TBC, Time between 9am-12pm

v.         Up to $50 each way (a total of $100) will be reimbursed to the prize winner for taxi to and from Mazda. Reciepts to be sent to victoria.hope@opera-australia.org.au

2.9.       Unless expressly stated in these terms and conditions all other expenses (including travel to and from the MAZDA pick up locations enlisted within clause 2.8 become the responsibility of the winner

2.10.     The winner will be responsible for, including but not limited to any negligent act performed by the driver or passengers involving the said vehicle: any loss or damage caused to, or by, the vehicle should the winner (or driver) be intoxicated or under the influence of medication or drugs whilst in control of the said vehicle: or any fines or penalties incurred for traffic infringements whilst the vehicle is in the custody and control of the winner (or nominated driver). The driver of the car must have a current Australian State or Territory license (which is not under suspension or cancellation) as at the date on which the winner (or companion) is to drive the vehicle.

2.11.     The use of the Mazda vehicle needs to be booked in advance by the winner, with Mazda through Opera Australia.

2.12.     Prize includes return economy airfares for 2 people from Sydney from the winner’s nearest capital city to Melbourne flying Qantas Airways. These flights need to be booked in advance by the winner, with Qantas through Tourism Victoria.  All travel is subject to Qantas’ Conditions of Carriage (which will prevail in the case of any inconsistency with these terms and conditions to the extent of that inconsistency). Prize flights are subject to S Class availability at the time of booking. The winner and their companion must travel together on all prize flights.  Prize flights cannot be upgraded with cash or Qantas Frequent Flyer points, and the winner and their companion will not earn Qantas Frequent Flyer points on prize travel or accommodation. There can be no changes to travel dates once tickets are issued.

2.13.     Peppers Mineral Springs Retreat includes two (2) nights accommodation in a Spa Villa valued at over $1000. This experience needs to be booked in advance by the winner, with Peppers Mineral Springs Retreat.

2.14.     Day Retreat Package for two (2) people at Hepburn Bathhouse & Spa is valued at $450. This experience needs to be booked in advance by the winner, with Hepburn Bathhouse & Spa.

2.15.     Three course dinner for two (2) people at Lake House is valued at $210. This dinner needs to be booked in advance by the winner, with Lake House.

3.      2nd Prize Terms and Conditions  

3.1.      Dinner or Lunch for six (6) people at ARIA restaurant, Sydney up to the value of $1500. This dinner or lunch needs to be booked in advance by the winner, with ARIA restaurant, Sydney.

3.2.      Any additional charges incurred are to be met by the raffle winner.

3.3.      This offer is valid for 6 months, starting 4 February 2013.

3.4.      Gift voucher will be provided to the winner and cannot be replaced if lost or stolen.

 

4.      3rd Prize Terms and Conditions

4.1.       Two nights accommodation at The Langham, Sydney is valued at $1200. This experience needs to be booked in advance by the winner with The Langham, Sydney.

4.2.       Gift voucher will be provided to the winner and will be valid for 6 months from 4 February 2013 and cannot be replaced if lost or stolen.

4.3.       The service must be received during the validity period, stated on the voucher, no exceptions made. Extensions will not be accepted.

4.4.       Gift Vouchers are non-refundable and no monetary exchange will be considered. The full value of the voucher cannot be partially redeemed.

4.5.       Any unused balance will not be refunded or credited.

4.6.       Gift voucher number must be stated at the time of booking and Gift Voucher must be presented when using the experience. The Langham, Sydney requires gift voucher numbers in order to verify/confirm validity.

4.7.       Gift vouchers cannot be discounted and cannot be combined with any other offerings.

4.8.       All bookings are subject to availability.

 

5.      4th Prize Terms and Conditions

5.1.       Professional portrait at Family Image is valued at $1000. This experience needs to be booked in advance by the winner, with Family Image.

5.2.       Gift voucher will be provided to the winner and will be valid until 30 July 2013.

5.3.       Gift Vouchers are non-refundable and no monetary exchange will be considered. The full value of the voucher cannot be partially redeemed.

5.4.       Gift voucher is non transferable.
 

6.      5th Prize Terms and Conditions

6.1.       Gift voucher valued at $500 redeemable at Ananas Brasserie, Sydney. This experience needs to be booked in advance by the winner, with Ananas Brasserie.

6.2.       Gift voucher will be provided to the winner as a card and will be valid until 15 January 2014. Voucher cannot be replaced if lost or stolen.

6.3.       The venue cannot accept responsibility for unauthorised use, lost or damaged cards. Please present card at the time of payment.
